The American Family Insurance 2013 Dream Camp Contest Rules


NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. ENTRANTS MUST BE LEGAL RESIDENTS OF THE FORTY NINE (49) UNITED STATES AND THE DISTRICT OF COLUMBIA. VOID IN FLORIDA AND WHERE PROHIBITED OR RESTRICTED BY LAW.  THESE OFFICIAL RULES APPLY TO THE American Family Insurance’s Go Get Your Dream Challenge (“CONTEST”).

AMERICAN FAMILY INSURANCE DOES NOT OFFER PRODUCTS IN ALL STATES.

ELIGIBILITY: This Competition is open to the public. Entrants must be (18) years of age or older at the time of entry. 

The following are not eligible: Employees, agents, agent staff, officers, and directors (including immediate family members) of American Family Mutual Insurance Company including their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, contractors, printers, web design, and advertising and promotion agencies, and any and all other companies or individuals associated with the administration, development, fulfillment and execution of this Contest (collectively, "Promotion Parties") are not eligible to participate. The term “immediate family member” includes spouses, grandparents, parents, siblings, children, and grandchildren and “step” of each. In addition, those living in the same households (those persons whether related or not who live in the same residence for at least three (3) months during the twelve month period preceding the start date of the Contest are not eligible to participate in this Contest.

2.        ADMINISTRATOR: 

This Contest is administered by American Family Mutual Insurance Company. The Administrator is responsible for the collection, submission and processing of entries and the overall administration and execution of the Contest. 3.        CONTEST PERIOD: 

Contest begins at 12:00:00 AM Central Standard Time ("CST") on December 31,, 2012 and ends at 11:59:59 PM CST on February 17, 2013 ("Contest Period").

    4.        TO ENTER: 

One entry per person. To enter the Contest, Entrants must visit amfam.com or facebook. The contest will deep link to http://www.youtube.com/amfam?x=us-en_dreamcamp2013 or https://www.facebook.com/amfam/app_332705240153159&app_data=us-en_dreamcamp2013 and complete the following tasks:

Task  A: Entrant must select one of the SIX (6) predetermined “Dream  

          Challenge” buckets:         

  1. Health,
  2. Career,
  3. Money,
  4. Home,
  5. Family; or,
  6. Passions.

     Task  B: Then Entrant must - Provide A Dream Description:

Step 1. Provide Title for 2013 their original dream, 100 characters or less of text.

Step 2. Upload photograph and 500 characters or less of text, of Entrant’s       original dream for 2013.

Step 3. (optional): Upload an audiovisual recording, 2 minutes or less, of Entrant’s original dream for 2013.

(*Under this section, Entrants much complete steps 1 and 2 while submission of an audiovisual recording in step 3 is optional)

      Task  C: Provide personal information, including name and email address and acceptance of the terms and conditions.

Submission of the above Dream Description along with all of the other entry requirements must be completed via the Contest website (“Submission Materials” or “Entry”) between 12:00:00 am CT December 31, 2012 and 11:59:59 pm CT February 17, 2013 (“Submission Period”). In order to be considered a valid Entry, the Submission Materials must conform to the criteria listed in Section 6 below.

As mentioned above, Entrants may enter the Contest only one (1) time. Any attempt to obtain more than one (1) entry, may lead to disqualification (as determined by Sponsor in its sole discretion). No substitutes for the official entry method may be used to enter the Contest, and Sponsor will not accept entries by U.S. Mail, email, fax, or any other way other than the methods listed above. All entries are the property of Sponsor. The Sponsor is not responsible for printing or typographical errors in any Contest-related materials, or any stolen, late, misdirected, lost, damaged, delayed, incomplete, or illegible entries. If there is a dispute as to who submitted an entry, the Sponsor will determine the entrant by who established the email account.

BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, AT SPONSOR'S SOLE DISCRETION.

Sponsor reserves the right to (and may or may not) monitor/screen Entries prior to posting them to the Website. By entering, Entrant acknowledges that Sponsor has no obligation to use or post submitted Entry. For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged by Entrants, American Family Mutual Insurance Company (“AFI”), may ask to license the material for use from entrants submissions. If AFI desires to edit the material they must request the original files via email from the contest entrant. The Entrant acknowledges the provision of information is made to the Sponsor, AFI and not YouTube or Facebook. The contest is no way sponsored, endorsed, or administered by, or associated with, Facebook. AFI shall have the right, in its sole discretion, to distribute the Submission Materials for any purpose which AFI deems necessary or desirable, and each Entrant irrevocably waives any and all so-called moral rights they may have therein. By submitting the Submission Materials, Entrants further represent and warrant that they have all necessary rights to grant AFI all publication and use rights. AFI shall have the right to freely assign its rights hereunder, in whole or in part, to any person or entity.  AFI shall retain the rights granted in the Submission Materials even if the Entrant is disqualified.  

ENTRIES POSTED TO THE WEBSITE ARE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.

Any waiver of any obligation hereunder by Sponsors does not constitute a general waiver of any obligation to Entrants.  

5.        CONTEST TERMS OF SUBMISSION: 

As conditions of Entry into this Contest, and by uploading Submission Materials, each Entrant warrants and represents on behalf of Entrant and every other member of Entrant’s participating family/friends, that Submission Materials (a) including any pictures or video that are submitted for this Contest are their original work, (b) that the Submission Materials do not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (c) that Entrant has obtained permission from any person whose name, or likeness is used in the Submission Materials and (d) and that publication of the Submission Materials via various media including Web posting, will not infringe on the rights of any third party rights. Any such Entrant will indemnify and hold harmless, the Promotion Parties and Sponsor from any and all claims to the contrary.  Each Entrant further warrants and represents that the Entrant has obtained permission from each person who appears in the Submission Materials to grant the rights to the Promotion Parties and Sponsor described in these Official Rules, and can make written copies of such permissions available to the Promotion Parties or Sponsor upon request. By submitting an Entry, Entrant agrees to the Terms and Conditions specified on this Web site and further agrees to never sue or assert any claim against the Promotion Parties' or Sponsor for use of the Submission Materials. Entrant agrees to indemnify and hold the Promotion Parties, Sponsor and its respective affiliates, officers, directors, agents, co-branders or other partners, and any of its employees (collectively, the "Contest Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Indemnitees due to or arising out of the Entrant's Submission Materials in the Contest, or the Entrant's conduct during and in connection with this Contest, including but not limited to claims of infringement of a party’s trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. Entrant agrees to release and indemnify and hold harmless Sponsor, any channels on which the contest resides inclusive of but not limited to YouTube, Facebook and the Promotion Parties from any and all claims that any advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsor or the Promotion Parties infringes on the rights of Entrant's work as contained in the Submission Materials.

Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest.  Should the Contest be terminated prior to the stated expiration date, notice will be posted on the Web Site and the Prizes may be awarded to potential Winners to be selected from among all applicable Eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsors. All interpretations of these Official Rules and decisions by the Sponsors are final.

Sponsor also reserves the right, at its sole discretion, to disqualify any individual who tampers with the Entry process, and to cancel, modify or terminate the Contest or any part of the Contest.  

Winner's Performance must not contain profane, unlawful, harmful, tortious, defamatory, libelous, obscene, invasive of the privacy of another person, threatening, harassing, abusive, hateful, racist, infringing, pornographic, violent or otherwise objectionable or inappropriate images or language as determined by Sponsor and must otherwise strictly conform to the reasonable requirements set forth by Sponsor.

Additional Requirements

  1. Regarding acceptable music, only Submission Materials that are determined, at the sole discretion of the Sponsor, as appropriate and compliant, will be deemed valid entries.
  2. No Entries will be returned. Sponsor may, in its sole discretion, remove, and/or disqualify Entries deemed to be inappropriate or otherwise non-compliant. Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Submission Period, to request that any Entrant resubmit his or her Entry which fails to comply with the Submission Requirements prior to any judging or voting period.
  3. Sponsor reserves the right to waive the Submission Requirements set forth herein in its reasonable discretion.
  4. Entrants must completely fill out the personal information on sponsor site
  5. Entries limited to one (1) person only.
  6. No Illegal, Infringing or Abusive Message Content: Entrants understand and acknowledge that they are responsible for the Submission Materials, and agree not to post any content that is unlawful, harmful, tortious, defamatory, libelous, obscene, invasive of the privacy of another person, threatening, harassing, abusive, hateful, racist, infringing, pornographic, violent, derogatory of any ethnic, racial, gender, religious, professional or age group or otherwise objectionable, inappropriate, or in violation of any law,  as determined by Sponsor.
  7. No Violations of Third Party Rights: Entrants agree that they will not post any content that contains personal information about any individual, violates the privacy/publicity of any other individual or entity, or anything that Entrant is under a contractual obligation to keep private or confidential. Entrants agree that they will not impersonate any person or organization, including without limitation, the personnel of Sponsor. Entrants further agree that they will not misrepresent an affiliation with another person or organization, nor will Entrant post any content that contains slanderous or libelous comments about others, or that infringes any copyright, trademark, patent, trade secret or other intellectual property right of a third party.
  8. No Commercial Use: Entrants agree that they will not post any content that contains business solicitation of any type, including advertising a product or service, offering a product or service for sale, or directing readers to a location for more information about a product or service.
  9. No Viruses, Corrupting Files or Interference: Entrants agree that they will not post any software, files or links to other sites, and that they will not post any content that contains viruses, corrupted files, or any other similar software or programs that may adversely affect the operation of the Web Site, or feature of the Web Site. Entrants further agree that they will not modify in any way any specifications, technology or application codes provided to Entrant by Sponsor or as embedded in the Submission Materials unless expressly authorized in writing by Sponsor.
  10. Responsibility of Postings: Entrants understand and acknowledge that they are solely responsibility for the Submission Materials, and that Sponsor is not responsible for the information, data, text or other materials that may appear therein. Opinions expressed in the Submission Materials do not necessarily reflect the opinions of Sponsor, and Sponsor does not endorse and has no control over content of the Submission Materials. The Submission Materials are not necessarily reviewed by Sponsor prior to posting and Sponsor makes no warranties, express or implied, as to the Submission Materials or to the accuracy and reliability of the Submission Materials.
  11. No Confidentiality: The nature of this Contest is interactive and public. By posting his/her Submission Materials, Entrants understand and acknowledge that any materials, ideas or other communications they transmit in any manner and for any reason are gratuitous and made without restriction and will not be treated as confidential or proprietary. Furthermore, Entrant acknowledges and agrees that any ideas, concepts, techniques, procedures, methods, systems, video, scripts, music, photographs, designs, plans, charts, or other materials Entrant transmits to Sponsor may be  disclosed on a non-confidential basis to anyone or otherwise used by Sponsor anywhere, anytime, and for any reason whatsoever without any additional compensation to you. Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and the Promotion Parties is not a confidential, fiduciary, or other special relationship, and that the Entrant’s decision to provide the Entrant’s Submission Materials to Sponsor for purposes of the Contest does not place the Promotion Parties in a position that is any different from the position held by members of the general public with regard to elements of the Entrant’s Submission Materials.  Each Entrant understands and acknowledges that the Promotion Parties have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees.  Each Entrant also acknowledges that many ideas or stories may be competitive with, similar or identical to the Submission Materials and/or each other in theme, idea, plot, format or other respects.  Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of any Promotion Parties' use of any such similar or identical material.  Each Entrant acknowledges and agrees that the Promotion Parties do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission Materials.  

Submission Materials that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in this Contest, in Sponsor's sole discretion.

6.        SUBMISSION MATERIALS FORMAT AND CONTENT REQUIREMENTS:

Technical Requirements

The technical requirements for the submission are listed below.

  1. No copyright restrictions on Submission Materials are permitted (any submission materials including content, photos, or video.
  2. Only picture of yourself and those directly related to your dream
  3. Video submission materials must be greater than 30 seconds and no more than 2 minutes in length,
  4. Supported video formats are WebM, .MPEG4, 3GPP, MOV, .AVI, .MPEGPS, .WMV, .FLV.
  5. Supported photo formats are .png, .jpeg, .jpg.
  6. Photos should be less than 1GB.

7.        How winners are selected: 

After entry, Entrants will be asked to share their submission via Facebook, email and/or Twitter asking others to vote for their dream. Sharing is not a requirement of the contest. Public online voting (“Judge” or “Judging”) is available to anyone. Voters can only place one vote per 24 hour period for one dream. Automated methods of voting are strictly prohibited. Voting through multiple accounts is strictly prohibited. 

Voting process:

  1. It is not required to enter the contest to vote.
  1. People can vote using YouTube voting as many times as they wish, but can only vote for one dream one time within a 24 hour period.  This is controlled through session/cookie logic.  If a voter wants more technical details on this subject, the voter can reach out to American Family Insurance at dreams@amfam.com for details.  Voting data will also be encrypted when stored in the database.

Voting happens from people interacting with the dream submission details of those who have entered the Contest on YouTube.  There is a vote button next to each Contest Entrants dream submission details for people to click to cast their vote.  Votes are captured in the database and used to track top dream votes and ultimately the Contest winners.  The winners are selected by the voters

Submission Materials received by valid Entrants during the Submission Period will be posted once approved. Entries that do not comply with YouTube Terms of Service and Community Guidelines will be disqualified. Entries will compete against each other for the prizes to be awarded. Valid submissions will be open for judging for the entire Competition Period.

The initial shared voting phase of the Contest will narrow the pool of potential Winners to 100 finalists. The Top 100 finalists will be determined by Entrants who receive the most votes for their Contest dream submission. Once the initial open voting phase of the Contest has been completed, the outcome of three prize winners will be determined by a panel of judges a/k/a the (judging panel”) as set forth below. The judging panel will serve as the sole determinant of the 3 prize winners of this Contest.

The judging panel will only review the Top 100 Entrant Submissions Materials.  The Submissions Materials will be evaluated by the judging panel based on the criteria set forth below.

8.        JUDGING CRITERIA:

The top 100 finalists Submissions Materials will be evaluated by a judging panel of representatives of the Sponsor. The judging panel will make its decision based on the following criteria:

  1. Inspiration (40%): Is the dream inspirational in nature and a positive representation of the American Dream?
  2. Feasibility (40%): Can the proposed dream realistically be accomplished with available resources in 2013?
  3. Impact (20%): Will it have a meaningful impact on the Entrant, someone close to them (friends or family) or another party?

9.        WINNERS ANNOUNCED:

On or about February 25, 2013, the Sponsor will determine the three (3) prize Winners from the top 100 finalist of the Contest as described above. If there is a tie, the Promotion Entities will conduct a random drawing among the Entrants who are tied to determine the winner. There will be 3 winners awarded in total:

10.         PRIZE PACKAGES: 

 Three (3) winners will be awarded to the entries with the most number of votes from the judging panelists.

  1. Three(3)  prizes each of $10,000 cash, and  a Dream Camp, dream mentoring/coaching experience to be held in Madison, WI . The approximate retail value (the “ARV”) of the Grand Prize is approximately $13,000. The ARV is subject to change based on current market conditions at time of Prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded. Arrangements for the fulfillment of the Prizes will be made by Sponsor. No substitution, transfer or cash equivalent of a Prize or any portion thereof is permitted, except by Sponsor, in which case a prize of equal or greater value may be awarded.  

A.        Dream Camp Mentoring Experience Requirements: 

As part of the Dream Camp Mentoring Experience the Sponsor and/or Promotion Parties shall be permitted by the Winners to videotape or record Dream Camp coaching sessions for use as described below:

  1. The winners will participate in an online chat – such as a Google Hangout – prior to Dream Camp. This will be to meet some of the other participants in the Dream Camp experience.

  1. The winners will have their Dream Camp mentoring sessions conducted in a predetermined location (Madison, WI) that is safe, secure, and conducive to the day’s activities. The locations for the mentoring experience will be the sole prerogative and in the sole discretion of the Sponsor and/or Promotion Parties.

  1. The Promotion Party’s film crew will require and, therefore, the potential Winners shall grant the Promotion Party and Sponsor time to document via film the potential Winner’s life in action – this may include but is not limited to time at their home, place of employment (assuming that doing so is permitted by the employer), favorite places of interests, the potential winner’s community, etc.  Potential video footage opportunities will be identified prior to the film crew arriving and may take place prior to and after the Winners’ time spent at Dream Camp in Madison, WI.

B.        Prize Acceptance: 

The pre-Dream Camp online chat, the filming of the Dream Camp  mentoring sessions as well as the prior and post filming sessions will also be a requirement of the prize package. The Winners must accept the entire prize package offered by the Sponsor which includes the monetary prize as well as Dream Camp mentoring experience that also includes the video shoots. If the potential Winners are unwilling or unable to accept the Dream Camp mentoring experience requirements, such potential Winners shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternative potential Winner may be chosen from among all of the remaining Eligible Entries received if time permits in Sponsor’s sole discretion. Winners must complete a prize affidavit form.

C.        Notification:

The potential Winner will be notified by e-mail and will be given instructions on how to claim the prize. The Sponsor will make a minimum of one (1) attempt over the forty-eight (48) hour period following the Winners’ selection to contact the Winner(s) via email associated with his/her winning Entry. If a potential Winner cannot be reached during the forty-eight (48) hour period in which he/she is emailed the potential Winner may be disqualified and, an alternate Winner may be selected from among all remaining applicable Eligible Entries received if time permits in Sponsor’s sole discretion.

D.        Winner Verification & Acceptance: 

Each Winner must prove eligibility, including, without limitation, proof of age and residence within three (3) days of being notified as a potential Winner.  In the event of non-compliance by a potential Winner, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules or if his/her Prize (hereinafter defined) or Prize notification is returned as undeliverable, such potential Winner shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternative potential Winner may be chosen from among all of the remaining Eligible Entries received if time permits in Sponsor’s sole discretion. Sponsor is not responsible for any change in Entrant’s mailing address, email address and/or phone number.  Each potential Winner (including each friend/family member who appears in or owns any rights in the Entry materials and recording)  must sign within three (3) days of receipt of such documents from Sponsors:  (a) an affidavit of eligibility and release of the Promotion Parties and their respective officers, directors, employees, agents, members, affiliated companies and subsidiaries; Facebook; Pinterest; and Twitter from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Contest or the use/misuse or acceptance of any prize or any portion thereof to be eligible for a Prize; (b) except where prohibited by law, a promotional release granting the Promotion Parties the right to use their name and likeness for advertising and publicity purposes without additional compensation; and (c) an agreement granting Sponsor all legal, rights, title, ownership, and interest in the Entrant’s submission materials.

Entry into this Contest constitutes agreement to sign such releases. Each potential Winner also must acknowledge that Sponsor has not and will not obtain or provide insurance of any kind relating to the Prize and that each potential Winner will be responsible for obtaining and paying for any property or other form of insurance relating to the Prize.  Each potential Winner must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the timeframe specified by the Sponsor or the potential Winner may forfeit Prize at the Sponsor’s sole discretion.  The Sponsor expressly reserves the right to delay the announcement of the Winners for creative or technical reasons or for any other reason the Sponsor deems necessary.

E.        Limit one prize per person/household:  

Prizes are non-transferable, non-cash portions are not redeemable for cash, and there are no substitutions, except in Sponsor’s sole discretion.

Entrants agree that the Sponsor has the sole right to decide all matters and disputes arising from this Contest. Any attempt by Entrant and/or his/her family/friends to vote more than the number of times authorized using multiple names or email address and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify Entrant in its reasonable discretion.

The decision of the panel of judges in their sole discretion shall be final and binding in all regards. For purposes of these Rules, Contest Grand Prize Winner shall be referred to as the “Prize Winner or Grand Prize Winner”.

11.        GENERAL CONDITIONS: 

The Sponsor reserves the right to amend the Official Rules at any time in its sole discretion due to amendment and/or adoption of new or existing laws and/or regulations regarding the administration, operation or for any other reason in the sound discretion of the Sponsor. Please check the Official Rules posted on the Website for any changes/modifications.

All costs and expenses not specifically listed herein are solely each Winner’s responsibility.  Winners are solely responsible to report and pay any applicable taxes on their prize. Each Winner must supply Sponsor with his/her social security number for tax purposes.  An IRS Form 1099 will be issued in the name of each Winner for the actual value of the Prize received.  By participating, Entrants agree to these Official Rules which are final and binding in all respects. Unclaimed prizes will not be awarded.

12.        LIMITATIONS OF LIABILITY AND RELEASE: 

Entrants agree that the Promotion Parties, Facebook, Pinterest, and Twitter (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or any Contest-related activity, or from Entrants’ acceptance, receipt, possession and/or use or misuse of the prize(s), and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prize(s), including, without limitation, to such prize’s quality or fitness for a particular purpose. Entrants also recognize that this contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Pinterest or Twitter; and that entrants are providing information  only to Sponsor and the Promotion Parties, and not to Facebook, Pinterest or Twitter.

 No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from any user's participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions or entries; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest. Sponsor and Promotion Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, Entrants agrees to release and hold Sponsor and Promotion Parties harmless from any and all claims, damages or liabilities arising from or relating to such Entrant's participation in the Contest.

13.        PUBLICITY:

Except where prohibited, participation in Contest and acceptance of prize constitutes each winner’s permission for Sponsor and Promotional Parties to use his/her name, address (city and state only), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each Winner regarding the Contest, Sponsor, or American Family for advertising or promotional purposes without notice or additional compensation.

14.        DISPUTES

Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Wisconsin or the appropriate Wisconsin State Court located in Dane County, Wisconsin; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees or court costs; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant, Administrator, and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.
